I am just an average guy! As you know from my home page we are at war. You think the Gulf War is something? Did you know that the Medical Community kills around 250,000 a year in medical malpractice alone? We need to wake up! That does not include the deaths caused by side effects to prescribed medications. In fact medications are essentially chemicals when it comes to the body having to detoxify itself of them. All chemicals have side effects. What the Pharmaceutical industry has done is to find the right combinations of chemicals to get the desired side effects to hide symptoms of diseases that we are having. Many of which are from other medications or chemical exposures. Unfortunately these synthetic chemical medications also have dangerous side effects. So it is a vicious chain reaction which is why so many people are taking 8 to 10 medications at a time. In fact many of these medications are the cause of deaths and no one fingers it as such.

The medical community does not like to say medications kill because that is their only tool and then if that was pulled then they would not be in business for the most part because they are not trained anymore to think for themselves. In fact if they did think for themselves they would lose there medical license on some trumped up charge.

Right now this is happening to a Dr. Rea in Dallas who helps those with MCS and EI and other environmentally caused ailments. The FDA and AMA have been sent to harass him as we speak. He does not fit into the Pharmaceutical And Chemical Industries box because he cures or minimizes the damage they are causing. Without more medications. He tells it like it is to the world and so the larger murdering industries want to hide the truth. So they try to use powerful agencies to discredit him publicly then destroy him once that has taken place and he is down.  They want to close his source of revenue so they can keep him down.

It is like a big bully in a play ground. He lies saying you told him so-and-so did this or that. Then when he thinks he has so-and-so on his side. He attacks you and pounds you to the ground and trys to crush you permanently.

That is how these agencies work. It does not matter if you are innocent of any charges or whatever they claim you did wrong. They use the media to do a smear campaign against you so in the publics eye you are the bad guy even though you did everything you could to be the good guy. In reality the bullies work for the bad guys or are the bad guys themselves.

This is why I am here. You see I was once not much in environmental causes. I always thought those Tree Hugger's where nut cases. Still do to some degree on that one. I also never realized that all the chemical products we are using where dangerous. I just always thought that our government would protect us from such dangers. I was very naive to say the least.

The way I look at it now is the way the American Indian's look at it. (Which I am over 1/4 American Indian also). Their saying is: "You can trust the US Government, just ask any American Indian?" For those who do not understand that, well  history shows what happened with they trusted the US Government and even recently the US Government has been stealing their lands for Power Plants and Oil Exploration and etc.

This site says it all. There is even a Chemical Company internal memo where the Chemical Companies say they are at war with us. In their war they have made all kinds of phony chemical company and special interest non-profit organizations.

One such bogus non-profit Organization is called American Council for Science and Health of ACSH.  I learned of this in researching my Worker's Comp. Insurance Carrier / Defense doctor. Dr. Thomas Allem. He was on their Board of Scientific Advisers.  This Board has 2 other notable opponents of Multiple Chemical Sensitivity (MCS) of Environmental Illness (EI) as it is now being called. Dr. Ronald Got's and Steven Barrett. Steven Barrett is the one also behind Quackwatchers.com and Quackbusters.com. This man is a self appointed persecutor of anyone or anything that is even close to a cure for any disease naturally or electronically. He is always threatening to sue whomever he can that says anything bad about him or whom finds the truths out about him. I once quoted a Tim Bollen in telling ACSH that they needed to be wary of him from what I learned about him before I learned that ACSH also was a front.  They sent him that threat. As it turned out he was their editor on Multiple Chemical Sensitivity articles. When he threatened me I said great, sue me. I told him then I could subpoena where you get all your funding. That was back in 1997 or 98. He never sued me. My guess is that the Pharmaceutical Industry is in bed with ACSH also because they are partly owned or they partly own the chemical industry. I read one article years ago where they are all tied together from CIIN. 

My Story!

To make a long story short I was a Furniture Repair Tech. II at Levitz Furniture. I worked for them for about 8 years. In that time I was getting ill all the time. Always thought I had the flu bug. I asked once about the chemicals I worked with to my supervisor but he said that they removed Benzene before I ever worked there so these chemicals where safe for us to use without protection. So since he never used protection I figured he was right. I never used it until about my 7th year I had internal bleeding and bleed both rectally and from my urinary tract also. I always got nose bleeds towards the last 4 years or so also so I figured once that I was in a fight in Gym class in my Junior High School years and I was tearing up this kid that started a fight with me and got a bit to excited and he had his head down and back turned facing me and I was running right at him and ran right into his fist sticking straight back at me while he was turned around not facing me. It gave me a bloody nose. So I figured that I was getting those bloody noses at Levitz from that situation that happened years ago in my Wood Shop Class. Never dreamed that chemicals could be the cause. So here I was strong and young and going super fast at what I did.  I was feeling real good and jolly a lot of the time I was at work. But when I got home I was burned out and angry and did not have a clue as to why most the time. I now know why. Those chemicals are the same as drugs and make you feel good while you are exposed to them. I am a Jehovah's Witness and I had not taken any drugs for many years and I was not drinking real heavy but I had a couple beers every now and then. I tried to stay in moderation. Turns out that I have since learned also that Beer and Chemicals do not mix. Your body will take the beer and detox that and store the other more toxic chemicals. I do not drink anything Alcoholic now thanks to that knowledge and the fact that beer rips my guts apart now due to this chemical injury.

I was initially injured with the bleeding internally in April 5, 1990. I was out for 3 months and they said it was a severe groin strain from lifting. I bought that. Then in Nov. 1990 I saw a doctor who asked me all kinds of questions about my work. I had to explain even the fine details of repairs and everything. He never told me what he was looking for but he was very detailed in everything.

Later my Lawyer calls me and tells me this doctor or QME was interested in the chemicals I worked with. I asked if I could get that information also to be on the safe side. He led me to believe that they had to be requested only through him. No one told me the information was called MSDS's. I did not find out about that term until I got my hands on that doctors report in June 7, 1995 and in a workers comp. pamphlet that I was given by the information officer at the WCAB the same day I fired my attorney and got all the records from him. My lawyer on the other hand knew the truth about this because he had that doctors report. He even sent them a letter explaining why it was appropriate that he submitted the amended application and that he was pending my disability status on receipt of the requested MSDS's and medical records. In that letter he served the insurance carrier, Travelers, on Dec. 24, 1990 the QME report suggesting chemicals. His later letter where he used a present tense statement concerning the amended application was dated January 19, 1991.  (I just learned this March 2008. All these years I have been misinterpreting this letter to Traveler's from my first attorney as pending the whole case or amendment on receipt of those MSDS's which never came anyway. In fact in June 1995 I requested them as the pamphlet said I could and they never sent me the ones for the right time frame of my employment. They had already played cover-up and hid or destroyed the chemicals MSDS's I worked with back when my attorney requested them in 01-19-1991. I do have brain injury from all these chemicals also. I misinterpret a lot of things I read. In the QME report dated Dec. 6, 1990 I was made TTD also. We recently learned this also as we where not looking for that one tiny sentence and back then we did not completely understand the term TTD and etc. It stands for Temporary Totally Disabled which is a oxymoron if you ask me. I was not suppose to be at work after Dec. 6th 1990. Of course my attorney had been contacted by Levitz attorney by then and had turned out to be working for them ever since they got his amended application and requests for those MSDS's and etc.) I was told that Levitz Defense Attorney of Hanna and Brophy Law Firm, a Albert Sennett was really scared and had contacted my attorney. Then my attorney gave me this big line about how the defense has there QME's or hired guns as he put it and he had his and that his doctor was paid to make up stuff like requesting chemicals and etc. This was right after the defense hired their attorney and he had already been in contact with mine. (Unbeknownst to me at that time my attorney had turn coated on me.) I could never reach him after that. In the mean time I was ill all the time I was at work when I was not even suppose to be in that environment if I had only known what was in my QME's reports where he made me TTD as we recently learned. I worked up until June 13, 1991 when I could not take the pain any longer which had switched over to my back. In March 1991 I went to a Dr. Kaplan of Concord Family Practice Center to figure out why I was ill all the time. That guy was a joke. Here I had all these abnormal readings in my blood tests but he said I was normal. Plus it was not suppose to be billed as a check-up because my insurance carrier would not cover it then so I never did pay the guy because he said he would not bill it as a check-up. He lied. I just figured we where on out own as has pretty much been the case all along even up till now. So I got injured other times but the company was too busy trying to keep me working even in pain so they could find a way to fire me and did not write up all those injuries I reported. They used my illness I was  having from the chemicals to suspend me and they where hoping to fire me. But something had to give and my back locked up on me and gave first to the point I could barley move. I made them take me to the hospital.

Then I saw the company Dr. Jew. He had me do some MRI's. I had seen him once before in 1986 or 87 and was only out for less than a month. This time he called me at my home. I had a friend that was a message therapist with me since she lived next door. Dr. Jew pretty much read off word for word what I later found out was what the MRI report said. I had him repeat it so she could hear. Then he explained that was why I was having pain down my legs. After he hung up she explained it telling me that the hairs on your arms are very sensitive and imagine them 1,000 times more sensitive and it being pain. I had encroachment in the foramina space which she said was the nerve space. That was right before the weekend and then on that next Monday I saw Dr. Jew and he said he could not understand why I was having pain down my legs. I called Traveler's Shari Fugatsu afterwards and told her the guy was a quack. She said she would straighten it out and he was nicer after that. But he sent me to Dr. Robert in the same building and he said the same thing to make a front against me. My wife did not believe they would do that so she came on a visit afterwards. (In the mean time I was doing therapy in his office and they had me on traction which when they released it I could hardly stand the pain was so severe and my muscles so weakened I know why now, I have a MS like disease from those chemicals and later medications).

When my wife went with me to Dr. Jew's appointment he said he could not see why I was having pain in my legs. My wife asked him : "So you are saying he can not have pain in his leg from this back injury?

Dr. Jew said nothing, so she calmly repeated it once more. We both watched him turning red in the face then he ran out yelling : "That's it! I am off this case!" Then he slammed the door as he was going out. I called the insurance company and told them I needed a new doctor from the company. No one told me I could go get my own after all this time I used theirs. So they sent me to Dr. Livermore

I was doing pretty good and was going through electronics retraining. I just finished lab building a power supply and was just starting computers when I had a flare up and my back pain got real bad and was affecting my performance in my work and testing. I tried to continue and Dr. Livermore was going on vacation. HE told me he could make it so I was not in class. I asked to let me keep trying and if it got worse then I would go out. He said to contact his office then if it got worse. Well I contacted them because I reacted to the medication he gave me and needed a different one. They refused and so my Rehab Councilor Ira Cohen said he could take me out. I meet with him at the school and he took me out. I could not lift my book bag at that moment due to the pain so I left my medical and school papers with my special office chair for my back in the instructors office where they said it would be safe. About a week later I came to pick it up and someone that very day riped all my medicals off and threw all my electronics papers everywhere in the class by the piano. Everyone in the class acted like they where afraid to say who did it when I asked. I know that my daily progress reports where in that case from Dr. Wristen before I went out on my back injury. I had made him copied but I tried to get them back from him and he said he did not have them. This was in 92,

Everyone seemed to be against me. It has been this way from the very beginning. My family can not believe I am having this much trouble with everyone. But I do. I then found out since Dr. Livermore's office was being such punks about giving me medications to control the pain that I could switch to a doctor of my own choice. SO I went to the same doctor who did Joe Montana's back surgery, Dr. Arthur White of Spincare in Daly City. He gave me Dr. John Pletz to take over. I was still having abdominal pains off and on also so I asked for a new doctor for that also. Shari Fugatsu of Travelers told me to use Dr. Pletz so I let him know about that also. He figured my front injury was more than likely caused by my back spinal encroachment. This was in 92 and none of us had Dr. Donnelly's 12-06-1990 and his May 1991 reports until June 7, 1995. My wife asked Dr. Pletz if my work environment could cause my symptoms as she did Dr. Kaplan of Concord Family Practice and he did not think so as Dr. Kaplan said "no" to my work environment in March 1991. By then when my wife even questioned this I scoffed at her. I did not know the symptoms so I had no clue I was poisoned by those chemicals. Even today I still have abdominal pains to the point that if my 10 year old daughter puts her weight on me belly it hurts real bad most the time. I wake up with a flatter belly but by the end of the day and before bed it is swollen to a real large size?

I am going to make this short and sweet because otherwise this could become a large book.

I fired my first attorney Mr. Healy. Because he could never be reached once they defense attorney was involved but he said it was because he was so ill. While I was out getting another attorney he went behind my back to San Francisco WCAB and said he wanted off my case and I was uncooperative. It was him that was difficult to reach but before it was judged he was off the case without our knowledge of that weasel act ion he did we already had Richard Jacobsmeyers who's wife was a insurance Carrier case worker. He promised he would never switch sides so we hired him. He lied. In hunting for a lawyer for my mother-in-law he switched to the defense and never told us. I called him on it and he writes after we already found out that he was defense and he was handing our files over to his partner. His switch was after a deposition with Defense Sennett. I do not remember the details but I had a argument with the defense lawyer at that deposition. He tried to strike something I said and I told him no. I can not remember clearly but I think I asked them what happened with the chemicals that where requested by my first attorney. Even Jacobsmeyers was acting like he was working with this guy, Mr. Sennett. Jacobsmeyers partner Vandersloot took over and said Jacobsmeyers was leaving his firm due to the conflict of interests. Well one year later Jacobsmeyers was still on the answering machine and Vandersloot did nothing for me. IN fact he set up a AME even though we agreed I was to get a QME of my choice first. At the time I was have emotional reactions to some medications and I fired him. That is when I finally saw Dr. Donnelly's reports and Mr. Healy letter to Travelers that I Misinterpreted ever since up until last month (March 2008 and about that I give the credit of seeing the truth of that letter to Jehovah God. Why? I prayed for the stone that hits them between the eyes and brings down this Goliath. Then I saw that 01-19-1991 letter on the floor in our office then I picked it up and there it was all the time. Mr. Healy did submit a amended application to toxic exposures and pended my disability status once he received the requested MSDS's and Medical reports. It was like I had instant clarity for a brief moment in time. Then I was back in this fog of a brain I have.) Any way After I figured it all out when I fired Vandersloot I was still on the medications that made me now think straight and say stupid things until I ended up in the Emergency Room in August 8, 1995 from the Ambien I used to sleep with. The same stuff that they said was found in Heath Ledgers apartment until their was a cover-up. Even Jack Nicholson said he warned Heath about that Ambien.  The Ambien got hushed hushed real quick. Then they said it was all kinds of other medications names. Someone was bought off to silence that one.

After that I have woken to pain from head to toe everyday. We sued the chemicals companies but they altered my deposition testimony and used a pieced together Social Security Document from different time frames and with someone else's check marks on many of the questions. It was a summary judgment and I was real ill at the time. I honestly looking back think they wiped me out in the depositions with chemicals because afterwards I started to recover. Up to then all the doctors my Civil Attorney sent me too where saying it was chemicals. Afterwards they all flipped and tried to say it was psychological.

The defendants in San Francisco Superior Court have get the Judge switched out to a Judge in their favor so far. Judge Mahoney was seeing our side of the issues and so forth adn all of the sudden he is in Family Court now. This new Judge says he can not understand my case pretty much in so many words and that I am declared a vexatious litigant based on the Cases I lost to the defendants when they where committing fraud and conspiracy and the Worker's Comp. Judges where siding with the defense and actually manipulating my case so I did lose and now they claim I am the vexatious litigant?

If you want to get technical my 3 rd attorney admitted in his demurrer that I was never given my reports from Dr. Donnelly until after I fired him in June 7th 1995. We recently figured out I was Temporarily Totally Disabled (from 12-06-1990 to June 13th 1991 which was the last day I worked for Levitz), at the end of 2007.  In Feb. - April 2008 after a heavy Prayer realized I already had a amended application to toxic substances sent to the defense as my 1st attorney's letter dated 01-19-1991 to the WC defense was making such a statement in present tense. It was like the words where lite up real bright when I saw that document on the floor and picked it up. I never realized it's true meaning until that day after that Prayer to Jehovah God through his son Jesus Christ. Since even then In a August 2008 demurrer from my 3rd attorney he states that this case was already submitted to the Worker's Compensation Appeals Board or WCAB and denied before he took the case which was towards the end of 1993 to the beginning of 1994 I believe when he took the case. Since I did not get my medical reports from Dr. Donnelly from the date it was generated to June 7th 1995 from not one of my own attorney's I had no real clue as to the true nature of the beast I was dealing with health wise.

Now that I see all the pieces of the puzzle including another new one where we just found out that when I had witnesses in June 3rd 2002 to be heard and they where never allowed to testify to the fact that there was gross negligence from Levitz in not training not just me but all the employees of the dangers of these chemicals and solvents we worked with, but also the WC judge had me write out the questions I was going to ask those witnesses and give them to her to have her do the questioning for me. Turns out that is a breech of ethical Judicial Practices. Worse than that. I had to give a copy of what I gave the judge to the defense also. My wife in dong her own case found out this fact from her judge because she asked if she was suppose to give him the questions she wanted asked as we did with my WC Judge. He told her that was not legal and he could get in trouble if she gave him the questions. I was scammed by this WC Judge I had! She manipulated the outcome of my trial by not allowing me my due process. Worse, there never was a issue of Statute of Limitations as it was files before 1994 and in fact more like Jan. 1991 according to that letter from my 1st attorney to Travelers Ins. So that you know, I may have to take this to federal as it is not even close to Constitutional what they are doing in this Justice system here in California.

In fact, if this was a real justice system and not a corrupted one, the DA would have arrested these people and did the investigations and so forth and fought this case for me pretty much.

This is showing how this state is completely unconstitutional and no one in Government and law is doing anything about it. The whole worker's compensation system and the States Justice System is corrupted. The DA's get bonuses paid for by the Insurance Companies to set people up and get them for insurance fraud even though they are innocent. About a year ago a Insurance Investigator came out in the news and said these people are innocent yet when they say they can not do something, all the investigator has to do is take one snap shot of them doing that movement or whatever and they are considered frauds! But on the other hand such as in my case here these Insurance and Employer and even my own attorneys conspire to hide information from me and sell me down the river to the insurance companies and deny me my benefits and hide what I needed to figure out what was really happening to me health wise. They even got the judge who initially told us if we proved negligence there was no Statute of Limitations. Then when we have the witnesses there to prove it she shuts us down not allowing them to be heard. Then years afterwards we find out through one of my attorneys demurrer that the WCAB had the amendment to toxic substances filed there all along. Which explains why the WC Judge destroyed all my WC records in 2004-05. She was covering up her tracks.

We can not get a lawyer with any guts to fight this for us. Because of the accusations we made against this WC Judge and other Judges side with her automatically. So how in the world are you going to get Justice here? These people commit the crimes and I ended up with a Multiple Schlerosis or MS type disease and Multiple Chemical Sensitivity or MCS which the later the medical community is trying to claim is all in the head and a psychological disease. (If it is psychological then shouldn't you first know what the symptoms are to to have it. I never heard of MCS until after June  1995 and I had the symptoms years before that. All the evidence showed that it was from a organic causations and even animals got it from chemicals and they do not have psychological issues like humans.)

The real fact is we are being exterminated. Think about it. Why is it that medical doctors are killing over 250K a year. Plus chemical pollution is killing millions a year but not being diagnosed correctly. For example how many die a year from Asthma attacks alone? Chemical Exposures caused those attacks. What about heart attacks and strokes? Medical Researchers found that pollution levels correlate with the incidences of Heart related diseases and strokes. How many a year is this killing? The best example is the medical testing itself. Back in 1995-96 Anti-Nuclear Antibodies or ANA's had a normal titer ratio of 1:20. Then it went up to 1:40. Anything above that was abnormal. Then they tried to move it up to 1:80 as normal but the medical doctors protested that one. So instead they completely changed the method of measuerments to IEU's or IU's . (I do not have it in front of me right now). When they changed the method of measurement they raised the normal range beyond the 1:80 range. They did this will all our blood readings.  They are either way lower than what is normal or way higher than what is really normal.

So I use the analogy that we are crabs in a pot of cold water. As the temperature gets hotter we do not notice it until it is too late. It is already too late and we still have not noticed it.

Whether it is global warming or cooling? The air is toxic or not? Pollution is out of hand in our food, water, and air. No matter what is done now we are too late so they are hiding it from us all by changing what is the values of normal. The rich are getting richer at the expense of the poor.

So when someone like myself figures out the scam and corruption they try to crush me with legal bull you know what. I feel this new judge is a ringer for the defense also. Why did they remove Judge Mahoney who got it and said that he was dismissing the case due to lack of jurisdiction which we disagreed with and he made it without amend on the Defendants Demurrer of Aug. 2008 yet this new judge crushed it recently? Judge Mahoney also when dismissing the case said with "prejudice toward all the defendants." meaning he saw the truth of the matter but because we initially did not name the WC Judge as part of the case he did not have jurisdiction. Which is also wrong because if that was the case this new judge could not have addressed the WCAB demurrer at all if he did not have jurisdiction.

I tired to reach this Dina Padilla (The Link above) who says she is fighting this WCAB corruption. I tired to get her to help me. Nothing! The only one who can help me is Jehovah God himself or someone he sends to help me. It is not right? I am poisoned for over 16,000 hours and get ill from it and they have the right to deny my injury caused by them not training me and never showing me a MSDS? It is corruption at it's finest and makes me sick of this state! I really fell like moving up north but my family is here. My daughters. I can not leave them. We are still fighting this even though it makes me ill to continue this as stress makes me sick also. It does anyone with a chronic disease of any sort. This is high stress for me.
